QUESTION

  1. Do you need witnesses when the girl gives her consent to the wakil to establish wakalat.
  2. Is there any limitations for witnesses such as not being from the girl’s side or the boy’s side for the nikah.

ANSWER

Witnesses are not required when the woman consents to the wakīl (representative) to conduct her nikāh. However, having two witnesses is advisable in case there are future disputes regarding her consent to the marriage.

There are no restrictions on who can be a witness for the nikāh, provided there are at least two witnesses (either 2 males or 1 male and 2 females). Witnesses can be any Muslim, from either the groom’s or bride’s side. While it is preferable that the witnesses be pious individuals, this is merely a recommendation and does not impact the validity of the nikāh.
